Terms of Service - dtElection

The Short Version

We're not going to bury important stuff in legal jargon. Here's what matters:

Be decent. Don't use dtElection for spam, illegal content, or anything harmful.
Your stuff is yours. We don't claim ownership of your polls or events.
Data gets deleted. Expired polls/events are automatically removed (30 days to 1 year depending on plan).
Free trial, then paid. Pro plans have a 14-day trial. Cancel anytime before it ends to avoid charges.
No refunds after trial. The trial is your chance to evaluate the service.
We can terminate accounts that violate these terms.

1. Acceptance of Terms

By accessing or using dtElection ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

dtElection is a privacy-focused scheduling and polling service that allows users to create polls, schedule meetings, coordinate events, and discover local happenings. The Service is provided "as is" and "as available."

3. User Accounts

To create polls and events, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your password and any 2FA credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. Voting on polls does not require an account.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Infringe on the rights of others
Send spam or unsolicited communications
Distribute malware or harmful content
Attempt to gain unauthorized access to our systems
Interfere with the proper functioning of the Service
Create polls or events containing illegal, harmful, or offensive content
Impersonate others or misrepresent your affiliation
Scrape or bulk-download data without authorization
Circumvent rate limits or abuse the API

5. Content and Data

You retain ownership of the content you create (polls, events, images, etc.). By using the Service, you grant us a limited license to store, display, and transmit your content as necessary to provide the Service.

You are responsible for ensuring you have the right to share any content you upload, including images and location data. Content that violates third-party rights may be removed.

6. Subscription Tiers and Pricing

dtElection offers different subscription tiers with varying features and limits:

Free: Unlimited polls and events, up to 5 slots per poll, 30-day retention
Pro: Up to 15 slots per poll, image uploads, 90-day retention, API access
Team: All Pro features plus team collaboration, SSO, and 1-year retention

Current pricing is available on our Pricing page. We reserve the right to change pricing with 30 days notice.

7. Free Trial

Pro plans include a 14-day free trial. During the trial:

You have full access to all Pro features
No payment is charged until the trial ends
You may cancel at any time before the trial ends to avoid charges
If you don't cancel, your subscription begins automatically and you'll be charged

Each user is eligible for one free trial. Creating multiple accounts to obtain additional trials is prohibited.

8. Payment and Refunds

Payments are processed by our payment provider, Polar.sh. By subscribing, you also agree to Polar's terms of service.

Refund Policy: Since we offer a 14-day free trial, we generally do not offer refunds for paid subscriptions. The trial period is your opportunity to evaluate whether the Service meets your needs.

Exceptions may be made at our sole discretion for extraordinary circumstances. Contact us if you believe you have a valid case.

9. Cancellation

You may cancel your subscription at any time through the customer portal in Settings. Upon cancellation:

You retain access to Pro features until the end of your billing period
Your account reverts to the Free tier after the billing period ends
Data exceeding Free tier retention limits may be deleted
No partial refunds are provided for unused time

10. Data Retention

Polls and events are automatically deleted after a retention period based on your subscription tier:

Free: 30 days after close/expiry
Pro: 90 days after close/expiry
Team: 1 year after close/expiry

You can manually delete your data at any time. Deleted data cannot be recovered. See our Privacy Policy for full details.

11. API Usage

If you use the dtElection API, you agree to:

Respect rate limits and usage quotas for your plan
Keep your API keys secure and confidential
Not share API keys or use them in client-side code
Not use the API for any unauthorized or abusive purposes
Attribute dtElection when displaying embedded content publicly

We may revoke API access for violations without notice.

12. Embedding and Widgets

dtElection polls may be embedded on third-party websites using our official embed code or WordPress plugin. By embedding:

You agree not to modify the embed code in ways that misrepresent the content
You remain responsible for the poll content displayed on your site
Poll creators can restrict which domains may embed their polls
We may disable embedding for polls that violate our terms

13. Intellectual Property

The dtElection name, logo, and all related trademarks, service marks, and branding are our property. You may not use these without prior written permission, except to link to or share dtElection content as intended by the Service.

14. Service Availability

We strive to keep dtElection available 24/7, but we do not guarantee any specific uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DTELECTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

17. Indemnification

You agree to indemnify and hold harmless dtElection and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

18. Termination

We may terminate or suspend your account immediately, without prior notice, for:

Violations of these Terms
Fraudulent, abusive, or illegal activity
Non-payment of subscription fees
Any other reason at our reasonable discretion

You may delete your account at any time through Settings. Upon termination, your data will be deleted according to our retention policy.

19. Changes to Terms

We may modify these Terms at any time. For material changes, we will notify you by email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance. If you disagree with changes, you may close your account.

20. Governing Law

These Terms are governed by the laws of Germany and the European Union. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Germany. Nothing in these Terms affects your statutory rights as a consumer under EU law.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
